Post Carbon Institute (“PCI”) makes no representations or warranties, and accepts no liability of any kind for any loss or damages resulting from the use of this site or any materials contained on it, which are provided 'as is' and 'as available'. PCI makes no representations or warranties that the materials in The Report are error-free, or that they are fit for any particular purpose or requirements. Nor does it warrant the mechanical operation of postcarbon.org or any of its contents. No statement in The Report is to be construed as a recommendation to buy or sell assets, or to provide investment advice. The Purchaser has purchased a non-transferable, non-exclusive, license to download and access a report, which will be subject to the following terms and conditions. Once your organization, or a person within it, has had access to any Content subject to these conditions, you are agreeing that your organization is deemed to be aware of, and consents to, this Agreement.

2. Refund/Cancellation Policy. Once paid, purchase fees for The Report are non-refundable. Sale or transfer of seminar tickets or credits is not permitted.

3. Use of The Report. You acknowledge that The Report is copyrighted by PCI and/or the report author(s) and is not to be copied, marketed, sold or redistributed in whole or in part for any purpose or by any means, including without limitation by photocopy or electronic dissemination, that are not in compliance with the Terms. You agree that you will not communicate or otherwise furnish, or permit to be communicated or otherwise furnished, elements of The Report, in any format and via any method, to any other person other than as specifically set out in these Terms. You agree that you will not use the CGPR and Storage Data and Proprietary Data or any information or data contained therein in connection with the creation, marketing, trading, clearing or settlement of any commodities contract in an organized market. The rights of use of The Report and contents therein set out above are subject to all of the limitations set forth in these Terms. You agree not to use the CGPR and Storage Data and Proprietary Data in any way that will violate or infringe any laws or regulations of any jurisdiction or the rights of any person, and you agree to indemnify and hold harmless PCI and the report author(s) against all claims, liabilities, losses, damages, costs and expenses incurred or suffered by us by reason of any breach of such responsibilities.

4. No Representation or Warranty. Your access and use of The Report is at your own risk. The Report and information therein is provided by PCI for information purposes only. Neither PCI nor The Author nor any of their respective affiliates, members, directors, officers, employees or agents, guarantees the accuracy, reliability or completeness of the content of The Report, nor shall any of them be liable to you, any other individual, or any entity for any delays, inaccuracies, errors or omissions in The Report, or in the transmission thereof, or for any other damages arising in connection with your receipt or use of The Report.

5. Liability. To the fullest extent permitted by law, PCI exclude all liability for any direct or indirect losses, damages, costs or expenses incurred or suffered by you or any other party arising out of or in connection with the access to, use of or reliance on The Report whether through negligence, tort, breach of contract or otherwise and howsoever arising. In no circumstances shall we have any liability for consequential or special damages.

6. General. These Terms shall be governed by U.S. and State of Oregon law and Oregon courts shall have exclusive jurisdiction in relation to any disputes arising from them or your use of the The Report. The invalidity or unenforceability of any part of the Terms shall not affect, impair or invalidate the remainder of the Terms.
